How we use the information

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.  

 

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Terms and Conditions for Booking Online Pest Control Services

1. Introduction

These terms and conditions (hereinafter referred to as "terms") govern your use of the online booking service (hereinafter referred to as "service") provided by Vendor Unlimited Pest Control, a pest control company incorporated under the laws of Missouri, with its registered office at 11628 Old Ballas Rd Suite 318, St. Louis, Mo 63141 (hereinafter referred to as Vendor Unlimited).

2. Eligibility

The service is intended for use only by individuals who are 18 years of age or older. By using the service, you represent and warrant that you 18 years of age or older and have the legal capacity to enter into these terms.

3. Booking and Payment

You may book the pest control service offered by Vendor Unlimited through the desired online booking service. The online booking service will guide through the process of selecting the type of service you require, the date and time you prefer, and the payment method. The service will provide you with an estimate of the cost of the services you have requested. The estimate is based on the information you have provided and may change based on the actual conditions at the location where the services are to be performed. The actual cost will be confirmed by the company prior to the commencement of the service. The service time you book does not guarantee that specific time and may be up to but not limited to 1 hour in advance or up to 2 or more hours after. If the service will be later than requested time Vendor Unlimited will notify you in advance to arrange for altered time.

4. Refund and Cancellation Policy - To Cancel Same Day Service, Please Call Us

Same day booking is convenient for and relied on by our clients, if a cancellation request is made within 6 hours or not by (phone call on same day service is due) prior to the scheduled service, a fee of 50% of the service requested will be charged. If canceling or rescheduling 24 hours or more in advance an email is sufficient enough for notification. Booking the same day, you acknowledge the service you need is an emergency. Vendor Unlimited reserves the right to charge 10% for services booked online and canceled within 24 hours of the requested time. Reoccurring misconduct may result in up to 100% of the charge of service requested. When a service is booked, that time slot is then filled to prevent overbooking.  We appreciate your understanding and cooperation in our attempt to prevent misuse of online booking as our customers prefer and value this option. 

Additionally, Vendor Unlimited reserves the right to cancel or reschedule the services at its sole discretion or due to weather. In such cases, the company will provide a full refund or an alternative date for the services as applicable. 

5. Warranties and Representations

Vendor Unlimited represents and warrants that the services will be performed in a professional and competent manner and in accordance with industry standards. Any outstanding balance past 30 days results in any warranties being null and void.

You represent and warrant that you have the right to use the location where the service to be performed and that you make the location available to Vendor Unlimited at the scheduled time. You also represent and warrant that you will cooperate with Vendor Unlimited in the performance of the services and provide access to the location as required along with any sanitation requirements.

6. Limitation of Liability

Vendor Unlimited Shall not be liable for any indirect, incidental, consequential, or special damages arising from or in connection with the use of the services or the performance of the services, even if the company has been advised of the possibility of such damages.

7. Modification of terms

Vendor Unlimited reserve the right to modify these terms at any time. The modified terms will be effective immediately upon posting of the service. You continued use of the service after the modified terms have been posted constitutes your acceptance of the modified terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Missouri and any applicable federal laws.

9. Dispute Resolution

Any dispute arising from or in connection with these terms or the service shall be resolved by mediation, if the dispute cannot be resolved through mediation, either party may seek resolution through binding arbitration in accordance with state and federal laws.

Our goal is to ensure that our customers receive the best possible service experience, from the initial booking to completion of the service. This policy outlines our standards and procedures for providing pest control services and explains how we handle customer inquiries and resolve any issues that may arise.

 

2. Service Description

We offer a range of pest control services. Our services are designed to control and eliminate a variety of pest. Our services are performed by trained and licensed professionals, using the latest techniques and equipment.

3. Service Area

We provide pest control services to customers in St. Louis Mo, and surrounding counties located in Missouri. If you're unsure whether we cover your location, please contact us for more information.

4.Service Process

Customers can book our pest control services online or by phone. To book online, customers can select there desired service and enter address for services to be rendered at. To book by phone customers can call between 6am-6pm Mon-Fri.

When booking online or by phone we require the service to paid in advance to eliminate the need for costly measures that are needed for getting invoices paid in full by customers. 

 

5. Service Guarantee

We are confident in the quality of service and the results we achieve. As such, we provide the following guarantees for our pest control services,

Guarantees are for customers with previous provided services with-in 30 days of initial service or unless otherwise stated in contracts. Guarantees do not hold value for the end result of any service unless otherwise stated in contract. Guarantees do hold value that we will provide a professional service and noticeable reduction in pest activity in observance of initial service. Services are designed for pest problems for which has just been discovered and not an ongoing issue you or another company has tried to eliminate, due to the nature of pest and their reproduction, on going issues may require a more extensive solution for control of the infestation and Vendor Unlimited reserves all rights to determine the level of infestation at time of inspection and verify if service is appropriate or if more is needed.

7. Service Plans

Service Plans are for customers who want to have their home or business on an automated service schedule to have property treated for pest covered under plan and that plan only unless otherwise stated in contract. It is understood by accepting the terms before the purchase of any plan, that monthly billing shall be current and card on file is not expired to have access to what that plan covers, and any warranties associated with your account. Service plans unless other wise stated covers up to a 2,500 sqft home or business, beyond that, price will be adjusted for size of home or business. Both parties reserve the right to cancel subscription or plan with a written notice 30 days prior to cancelation date.

8. Equipment

 Vendor Unlimited is the owner and remains the owner of the equipment used in services; an initial deposit is required on equipment left at your premises. If the equipment is lost or damaged due to customer negligence, customer is responsible for replacement cost of the equipment. Deposit is nonrefundable if the equipment is not able to be recovered or in same condition as received.

9. Force Majeure

 For the purpose of any service agreement, "Force Majeure Event" shall mean any event or circumstance not within the reasonable control of either party, including but not limited to acts of God, fire, flood, war, government action, labor disputes, strikes, lockouts, epidemics or any other event which is beyond the reasonable control of either party and which causes the failure of Vendor Unlimited to perform its obligations under this agreement shall not be liable for any damages, expenses, or other liabilities associated with any service in such event.

10. Anti-Corruption and Anti-Bribery

No party shall offer, promise, give, request, or receive any bribe, kickback, or other illegal or unethical payment or advantage to or from any person or entity in connection with our agreements. The parties shall cooperate with each other and with any regulatory authority in connection with any investigation or prosecution arising out of or relating to this agreement or a violation of this anti-bribery and anti-corruption clause.

11. Class Action Waiver

The parties in any agreement with Vendor Unlimited agrees to resolve any disputes arising out of or relating to any agreement on an individual basis and to waive their right to participate in a class action or class-wide arbitration.

12. Ownership of Intellectual Property

All intellectual property rights, including but not limited to patents, trademarks, copyrights, trade secrets, and know-how, arising out of or relating to the performance of any agreement with Vendor Unlimited shall be the exclusive property of Vendor Unlimited Pest Control.

13. Data Security

Vendor Unlimited complies with all applicable laws, rules, and regulations regarding the protection and processing of personal data and is not liable for any data breaches or the interception of customer data.

14. Marketing

When deciding to use our services, you agree to Vendor Unlimited reserving the right to use information you provide in marketing, including but not limited to, name, address, and electronic mail. Your information will not be sold and is solely for improving customer experience with companies partnering with Vendor Unlimited.

15. Exclusion Services

Exclusion services provided by Vendor Unlimited are solely intended to prevent pest from entering the property. These services are not intended to provide cosmetic improvements to the property and Vendor Unlimited is not liable for any depreciation, damages, or expenses incurred with any exclusion service provided with the purpose of keeping pest out of the property. Exclusion services are provided as emergency and preventative solutions, they may be permanent but not limited to wear and tear, misuse, tampering, or any other factor other than it's intended use, Vendor Unlimited is not responsible for replacement. Also, Vendor Unlimited does not offer any warranties for any products manufactured by any other company.

16. Sanitation Assistance

Sanitation Assistance refers to any service provided by the company to assist with cleaning or sanitizing a customer's premises. Sanitation Assistance is not a standard service offered by Vendor Unlimited unless specifically stated in the contract between Vendor Unlimited and the customer. The decision to offer Sanitation Assistance is at the discretion of Vendor Unlimited and reserves the right to amend, terminate or otherwise offer this assistance as part of any service.

17. Service Payment 

At Vendor Unlimited, we take pride in providing prompt and efficient pest control services to our clients. We understand that unexpected circumstances can arise, and we strive to accommodate our clients' needs. However, we also have policies in place to ensure that we are compensated for our services.

Our payment terms require payment upon receipt or if reoccurring invoices within 30 days of the services. If payment is not received within this timeframe, a late fee of 10% will be added to the invoice. Additional 10% for each month after until invoice is paid in full.

If payment is not received upon receipt a series of emails and text ranging from 3 to 60 days will be sent.

We understand that there may be circumstances beyond your control that may prevent you from paying on time. If you experience such an issue, please contact us as soon as possible, and we will work with you to find a solution that works for both parties.

If payment is not received after the late fee has been added to the invoice, we may take additional action to collect the amount owed, Including referring the matter to a collection agency. The client is responsible for additional cost or fees incurred by Vendor Unlimited to collect debt.

18.Termite Plans

Termite Baiting plans include installation, maintenance, replacement of baits and stations as needed on annual reoccurring inspections. Plans are in monthly installments of the total annual renewal agreement based on property size and or number of stations required to protect the property. The stations are not sold upon installation and remain property of Vendor Unlimited, the fee covers any home up to 2,500 Sqft not including detached structures for the cost of the installation, maintenance and replacements of any stations or bait for the first month, followed by the monthly installments of the total annual agreement.

Referral Program / Promotions / Coupons / Discounts

1. Definitions: in these terms and conditions, "we," "us," and "our" refer to Vendor Unlimited, the provider of pest control services. "you" and "Your" refer to the individual or entity using our services. "coupon" refers to any promotional offer, discount, or coupon code provided by us. 

2. Coupon Usage: Coupons are only valid for use by the recipient and may not be transferred, sold, or traded. Coupons may not be combined with any other promotion, coupon, or discounts unless specifically stated otherwise.

3. Eligibility: Coupons are only valid for services performed by us and are not redeemable for cash. Coupons may have certain restrictions and exclusions, such as location, type of service, or date of service, and it is your responsibility to review and comply with these restrictions.

4. Referral Program: Our Referral Program allows you to earn rewards for referring new customers to us. Rewards are subject to the terms and conditions of the referral program, including but not limited to restrictions on the number of referrals, the value of the rewards, and the method of payment.

5.Expiration: Coupons and rewards may have an expiration date and will be void after the expiration date.

6. Misuse: Misuse of coupon, including but not limited to attempting to exchange them for cash or reselling them, is strictly prohibited and may result in the cancellation of the coupon or referral reward.

7. Changes to terms and conditions: We reserve the right to modify or terminate our referral program, promotions, coupons, and discounts at any time without notice. It is your responsibility to review these terms and conditions periodically for updates.

8. Governing law: These terms and conditions are governed by the laws of Missouri and any applicable federal laws. Any disputes arising from or related to these terms and conditions, or our services will be resolved by mediation, if not resolved by mediation the dispute will be resolved with arbitration.
